ECT Italy SRL operates under the commercial name Thai Three Seasons by Amara Oasis and is subject to Italian legislation, including Legislative Decree No. 70 of 9 April 2003 on Information Society Services and Electronic Commerce.

 

2. Object and Scope of Application

These General Terms and Conditions govern access to and use of the e-commerce platform available on the website https://thaithreeseasons.com and regulate the contractual relationship between the User (hereinafter, “User”) and ECT Italy SRL, in connection with the purchase of wellness and massage services provided through the site.

The services offered include, but are not limited to:

  • Massage sessions (individual or as a gift)
  • Promotions and discount offers
  • Purchase of digital gift cards
  • Online booking for services provided on-site

Access to the website is allowed only to individuals over 18 years of age or to legal persons acting through authorised representatives. These Terms are binding from the moment a purchase or booking is confirmed by the User.

These conditions are governed by applicable Italian and European laws, including:

Users declare they possess the legal capacity to enter into binding contracts under Italian law. Acceptance is a necessary condition to formalise the purchase of services and constitutes a legally binding agreement between the User and ECT Italy SRL.

Should the User not agree with these conditions, they must refrain from using the website and its services. ECT Italy SRL reserves the right to update or modify these Terms at any time, with changes taking effect upon their publication on the website.

 

4. User Registration and Booking

To access certain features, such as booking massages or purchasing gift cards, the User must register by providing accurate and up-to-date personal information. The User is responsible for maintaining the confidentiality of their login credentials and agrees not to disclose or transfer them to third parties.

Booking of massage services is carried out through the online platform and is subject to confirmation via email. The User must attend the selected appointment or cancel in accordance with the cancellation policy detailed in section 9.

ECT Italy SRL reserves the right to cancel or suspend accounts in the event of fraudulent activity, violation of the terms, or provision of false data.

 

5. Prices, Taxes and Invoicing

All service prices displayed on the website https://thaithreeseasons.com are in Euros (€) and include applicable Value Added Tax (VAT) in accordance with Italian tax regulations (D.P.R. n. 633/1972).

Any additional costs, such as surcharges for specific services or optional extras, will be clearly indicated prior to payment confirmation.

Upon request, a digital invoice will be issued and sent to the email address provided by the User during the booking or purchase process. ECT Italy SRL complies with electronic invoicing requirements established under Italian Law (Legge di Bilancio 2018 and successive regulations).

 

6. Payment Methods and Security

Payments for services offered on this website may be made via secure electronic methods, including credit/debit cards, PayPal, or other online payment gateways as indicated during the checkout process.

All transactions are processed through encrypted connections and secure third-party platforms that comply with PCI-DSS standards and Italian regulations concerning electronic payments.

ECT Italy SRL does not store Users’ payment card details. Any fraudulent, unauthorised, or suspicious activity must be reported immediately to both the service provider and the payment institution involved.

 

7. Booking and Purchase Process

The User may book massage services or purchase gift cards and wellness-related services directly through the website https://thaithreeseasons.com. To confirm a booking or purchase, the User must follow the indicated steps, provide accurate personal and billing details, and complete payment through the secure checkout system.

The booking will be considered confirmed once payment is successfully processed and the User receives an email confirmation. All contractual obligations are deemed accepted at that time, pursuant to Article 1326 of the Italian Civil Code.

Gift cards are valid for 12 months unless otherwise stated, and may be redeemed exclusively for services listed on the website, subject to availability.

 

8. Right of Withdrawal and Refund Policy

Pursuant to Article 59 of the Italian Consumer Code (D.Lgs. 206/2005), the right of withdrawal does not apply to services related to leisure activities scheduled for a specific date, including massage appointments.

However, ECT Italy SRL allows cancellation and rescheduling up to 24 hours before the scheduled appointment, unless otherwise indicated in the specific service conditions. In such cases, a refund or rescheduling will be offered based on availability and at no additional cost.

Gift cards are non-refundable and non-transferable, except in cases of proven technical issues or legal requirements. Any request for withdrawal or complaint must be addressed to info@thaithreeseasons.com.

 

9. Price, Payment Methods and Invoicing

The prices of services and products are displayed in Euro (€) and include VAT, in accordance with Article 21 of Presidential Decree No. 633/1972. Any applicable discounts or promotional offers will be clearly indicated before completing the order.

Payments may be made using the methods available on the platform (e.g., credit card, PayPal, or other secure online systems). All payment transactions are processed through encrypted protocols and comply with PCI DSS standards.

Upon completion of the purchase, a digital invoice will be issued and sent to the email address provided by the User, pursuant to Article 22 of Presidential Decree No. 633/1972.

 

10. Obligations of the User

The User agrees to use the website and services in accordance with applicable law, these General Terms and Conditions, and principles of good faith and fair dealing, as set forth in Article 1175 of the Italian Civil Code.

The User shall provide accurate, truthful, and up-to-date information when registering or making purchases, and is responsible for safeguarding login credentials and any activity carried out under their account.

Any fraudulent use of the website, including unauthorised access, payment misuse or disruption of services, will be prosecuted under applicable civil and criminal provisions, including Articles 640 and 615-ter of the Italian Penal Code.

 

11. Right of Withdrawal and Refund Policy

Pursuant to Articles 52 and following of Legislative Decree No. 206/2005 (Italian Consumer Code), the User has the right to withdraw from the contract within 14 days from the date of purchase, without providing any justification and without incurring any cost other than those provided by law.

To exercise this right, the User must submit an explicit withdrawal request via email to info@thaithreeseasons.com. If the service has not yet been performed, the full amount paid will be refunded within 14 days of the withdrawal notification using the same payment method employed in the original transaction.

No withdrawal is permitted once the massage service has been performed in full, pursuant to Article 59, letter a) of the Consumer Code.

 

12. Gift Cards and Promotional Codes

Gift cards and promotional codes are valid only for the period and under the conditions indicated at the time of issuance. They cannot be exchanged for cash or refunded, even partially, except where required by law.

Promotional codes must be applied before completing the order and cannot be combined with other discounts unless otherwise specified.

The improper use of codes, such as their unauthorised reproduction or distribution, will result in the immediate suspension of the associated account and potential legal action under Article 2598 of the Italian Civil Code regarding unfair competition.

 

13. Complaints and Customer Support

All complaints will be addressed as quickly as possible and no later than 15 working days from receipt, in accordance with Article 27 of Legislative Decree No. 206/2005 (Consumer Code).

14. Alternative Dispute Resolution

According to Article 141-sexies of the Italian Consumer Code and Regulation (EU) No 524/2013, consumers may resort to the online dispute resolution platform (ODR) provided by the European Commission, accessible via the following link:

Consumers residing in Italy may also access the alternative dispute resolution mechanisms recognised by the Chambers of Commerce or other ADR entities registered in the national list held by the Ministry of Enterprises and Made in Italy (MISE).

 

15. Jurisdiction and Competent Courts 

Any disputes arising from these General Terms and Conditions of Sale shall be subject to the jurisdiction of the courts of the place of residence or domicile of the consumer, if located within the territory of the Italian Republic, in accordance with Article 66-bis of Legislative Decree No. 206/2005 (Consumer Code) and Regulation (EU) No 1215/2012.

For users not qualifying as consumers, the exclusive jurisdiction will lie with the Court of Milano.

These General Terms and Conditions of Sale are governed by Italian law, including Legislative Decree No. 206 of 6 September 2005 (Consumer Code), Legislative Decree No. 70 of 9 April 2003 (implementing Directive 2000/31/EC on electronic commerce), and the Italian Civil Code.

Any matter not expressly covered herein shall be regulated by the applicable provisions of Italian law.

If any clause in these General Terms and Conditions is deemed invalid, void or unenforceable for any reason, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
